VIBESOVERSEAS LTD – 2025 Terms and Conditions – VibesOverseas Portugal (“Event”)

GENERAL

1.⁠ ⁠These terms and conditions (“T&Cs”) incorporate any site/venue owners’, vendors’ and/or agents’ terms or rules, which you can get from the official ticket agent. Your possession of a ticket constitutes your acceptance of these T&Cs.

 2.⁠ ⁠The term “Event” may refer to any individual VibesOverseas Portugal  2025 event or any combination of such events or all of the VibesOverseas Portugal  2025 events as may be required in the circumstances and each provision of these T&Cs can be applied to any or all of these events, as applicable in the circumstances.

 3.⁠ ⁠“Us”, “We”, “Our”, “VibesOverseas”, means VibesOverseas LTD and/or its respective representatives, employees, and sub-contractors.

 4.⁠ ⁠We reserve the right to implement restrictions/conditions before and during the Event to ensure it is safe. You must comply with any and all instructions given to you by Event staff and stewards and you may be evicted without a refund if you fail to comply. 

 5.⁠ ⁠We reserve the right to refuse admission or to remove any person from the Event sites (references to “Event site(s)” to include all Event venues within such sites), without refund, for reasons of public safety (including for crowd surfing or moshing), any unacceptable behaviour likely to cause damage, nuisance or injury, or for any breach of these T&Cs.

 6.⁠ ⁠No liquids, gels, or lotions are permitted into the Event. This includes soft drinks / water in sealed containers. Sun cream, perfume, and make up will be permitted in plastic or paper containers sized 100ml or less. Glass containers of any size will not be permitted. Any gels or liquids that do not comply will be disposed of by security staff.

 7.⁠ ⁠Tickets are for the Event and any billed Artists and attractions may be subject to change.  

 8.⁠ ⁠The Event is big bag free. Only bags smaller than a piece of A4 paper will be permitted. People without bags will get into the Event quicker.

 9.⁠ ⁠No trading or promotional activity is allowed within any Event site without Our prior written consent. Goods using unauthorised logos must be surrendered to Event staff.

10.⁠ ⁠By entering the Event sites, you give your express consent to your actual/simulated likeness to be included for no fee within any audio or visual recording to be used in any media for any purpose at any time, including CCTV, filming by the police or security staff and/or for marketing.

11.⁠ ⁠Food and drink will be available for purchase at the Event.

12.⁠ ⁠These T&Cs are subject to change from time to time in our sole discretion and We will notify you by posting the amended T&Cs to the Event website.

13.⁠ ⁠We shall have no liability for any loss, injury, illness, or damage to any person or property sustained at the Event howsoever caused (including by Us and Our agents) in any circumstances unless caused as a direct result of Our negligence and that which cannot by law be excluded or limited. Any personal property brought to the Event is at your own risk.

14.⁠ ⁠We may prosecute you if you cause damage to the Event sites, the sites’ infrastructure, or cause harm to any other person at the Event and/or the Event sites. 

15.⁠ ⁠These T&Cs are governed by English Law and any dispute arising out of or in connection with these T&Cs shall be subject to the exclusive jurisdiction of the English courts.

REFUNDS

1.⁠ ⁠Refunds are only considered if the Event is (i) cancelled in full and not rescheduled (if the Event is partially cancelled your refund will be a proportionate partial refund) or (ii) materially altered which is a change (other than a rescheduling) which, in Our opinion, makes the Event materially different to the Event that ticket purchasers, taken generally, could reasonably expect. The following are not deemed to be ‘material alterations’: changes to the Event line-up; adverse weather conditions; changes to individual band members; curtailment of the Event where the majority of the Event is performed; and delays to starting a performance or the Event.

 2.⁠ ⁠Refunds must be requested from the point of purchase, no later than three months after the Event.

 3.⁠ ⁠Refunds of any booking fees per ticket or per order fees are subject to the terms and conditions of the point of sale.

 4.⁠ ⁠Personal arrangements relating to the Event including, but not limited to, travel, subsistence and accommodation are at your own risk and We shall not be liable for any losses incurred from personal arrangements or wasted expenditure beyond the ticket refund.


DISPUTES AND CHARGEBACKS

1.⁠ ⁠General Provision on Disputes and Chargebacks

Except where exercising rights under section 75 of the Consumer Credit Act 1974 or other statutory rights that cannot be excluded, you agree not to initiate a dispute or chargeback with your card issuer or financial institution regarding any transaction with us.

2. Default or Modification of Payment Plan

If you default on, unilaterally amend, or agree to cancel any agreed payment plan or booking, as defined in Clause 12, you agree not to initiate any dispute or chargeback in relation to such transactions, except as permitted by statutory consumer protection laws.

3. Third-Party Booking Protection

If you purchase booking protection through XCover.com at checkout and any claims under that policy are denied, or, you do not attempt to make a claim, you agree not to initiate a dispute or chargeback with your bank in relation to the original booking transaction with us. Any claims regarding the booking protection product must be pursued directly with XCover.com, as we hold no liability for their decision.

4.  Refunds and Claims

Your rights to refunds, claims, or other remedies shall be governed by these Booking Conditions in addition to any statutory rights that cannot be excluded under applicable consumer law.

5.  Chargeback Defence

In the event of any improper or unjustified chargeback attempt, we reserve the right to present this Clause as evidence to defend against the chargeback with your financial institution.


NAME CHANGES

1.⁠ ⁠Introduction

A non-refundable name change fee of £25 applies for any request to amend the name on a ticket within a booking.

2.⁠ ⁠Applicability

The name change fee applies to the lead booker who wishes to transfer the ticket to another individual by updating the name on the ticket. Only one name change is allowed per ticket within a single booking.

3.  Fee Amount

The fee for changing the name on a ticket is £25 per ticket. This fee is non-negotiable and non-refundable.

4.⁠ ⁠Process

To initiate a name change, the lead booker must contact VibesOverseas Customer Support before July 1st, 2025. The request must include the original ticket holder's details, along with the new ticket holder’s full name, date of birth, telephone number, gender, nationality, and country of residence. Once payment is completed, our team will process the change.

5.  Payment

The name change fee must be paid in full before the ticket details can be updated.

6.⁠ ⁠Deadline

All name change requests must be submitted and processed prior to June 14th, 2025. Requests submitted after this date will not be considered.

7.⁠ ⁠Transferability

The name change fee applies per ticket and is non-transferable between ticket holders. Only the lead booker will be contacted regarding amendments to a booking.

8.⁠ ⁠Verification

VibesOverseas Portugal reserves the right to verify the identity of both the original and new ticket holder before processing any name change. Failure to provide satisfactory identification may result in the refusal of the name change request.

9.  Payment Plan Completion

All payments under any payment plan must be completed before submitting a name change request. If the customer wishes to pay off the balance early to facilitate a name change, they should contact us at contact@vibesoverseas.com

10.⁠ ⁠Limitations

The payment of the name change fee does not guarantee approval of the request. VibesOverseas Portugal reserves the right to reject any name change request at its discretion.

11.⁠ ⁠No Refunds

The name change fee is non-refundable under any circumstances.

12.⁠ ⁠Final Decision

All decisions regarding name change requests, including approval, denial, and eligibility, are at the sole discretion of VibesOverseas Portugal and are final.

13.  Modification of Terms

VibesOverseas Portugal reserves the right to modify or update these terms and conditions at any time without prior notice. The lead booker is responsible for reviewing the most current terms and conditions before submitting a name change request.

14.  Acceptance

By requesting a name change and paying the associated fee, the lead booker agrees to be bound by these terms and conditions.


AGE POLICY

1.⁠ ⁠The Event is strictly limited to persons aged 21 and over. Individuals must be prepared to show valid photographic identification on request such as a passport, European ID photocard, or a UK/EEA photocard driving licence.

TICKETS

1.⁠ ⁠It is prohibited to resell tickets for the Event except where resold using the official resale platform of the official ticket agent you purchased from, in accordance with the relevant agent’s resale platform’s terms and conditions.

 2.⁠ ⁠Tickets and wristbands purchased from unauthorised sources may be rendered invalid and admission refused. Only wristbands issued by Us in exchange for a valid ticket are valid for entry.

 3.⁠ ⁠Tickets must be valid, presented in full, with stubs and not tampered with (in the event of accidental damage, refer to point of purchase prior to Event).

 4.⁠ ⁠Tickets for this Event have a unique barcode which will be scanned on entry and if found to be duplicated, either in error or for fraudulent gain, only the first instance of the ticket scanned will be admitted regardless of original ownership. Customers may be prosecuted if found to have deliberately duplicated and resold tickets for fraudulent gain.

 5.⁠ ⁠Once scanned for entry, tickets will be retained by the Event. 

 6.⁠ ⁠Tickets cannot be used as part of any marketing, media or sales promotion, without the prior written consent of VibesOverseas.

 7.⁠ ⁠If you have obtained a ticket in breach of these T&Cs and/or if you breach any of these T&Cs then your ticket will be void, and all rights conferred on you or evidenced by such ticket shall be void. If you seek to gain entry to the Event using a void ticket then we reserve the right to refuse you entry to or evict you from the Event and you may be liable to legal action for trespass. Void tickets are non-refundable.

 8.⁠ ⁠You may leave and re-enter the sites during the Event provided you are wearing valid wristbands issued by Us in accordance with this Tickets section, and provided such wristbands remain untampered.

 9.⁠ ⁠Ticket holders should expect queues at the various points of entry to the Event and arrive with plenty of time before the first act that they wish to see – no refunds will be given for acts missed.

10.⁠ ⁠We will not issue duplicates for lost or stolen tickets or wristbands. Tickets and wristbands remain Our property until the Event closes.

11.⁠ ⁠Your booking is not considered complete until we have received full payment - if installment payments are missed, you will be charged a late fee and/or have your booking revoked.

SECURITY

1.⁠ ⁠Searching is a condition of entry and you may be searched anywhere on each Event site at any time by security.

 2.⁠ ⁠Without liability to you, We shall be entitled to confiscate any item(s) which may reasonably be considered to be a weapon (or used as a weapon) or which may cause danger, offence, or disruption to any other person.

 3.⁠ ⁠Any person suspected of carrying illegal items or carrying out illegal activity may be handed over to the police, refused entry, or evicted from the Event sites without a refund.

 4.⁠ ⁠The Event has a zero tolerance policy to drugs. Anyone found in possession of illegal drugs or substances may be refused entry or ejected from the Event sites and may be handed over to the police.

 5.⁠ ⁠We reserve the right to evict customers without refund and/or refuse admission where this Security section is breached.

 6.⁠ ⁠You may be body/bag searched anywhere on the Event sites at any time by security. Searching is a condition of entry.

 7.⁠ ⁠Any item(s), reasonably considered to be a weapon (or used as a weapon), which may cause danger, offence or disruption to any other person will be confiscated.

BANNED ITEMS

1.⁠ ⁠Banned from Event: Aerosols, Airhorns, Alcohol, Animals (except for assistance dogs), Balloons, Barbecues and any kind of cooking apparatus, Bicycles, Blowtorches, Cans, Chairs of any sort (including stools, floor seating and shooting sticks), Drinks including bottled water, Drones, Drugs, Gas canisters, Gazebos/parasols/large (golf) umbrellas, Glass (including glass makeup or perfume bottles), Food hampers/cool bags/boxes, Fires, Firewood, Fireworks, Flags on poles, Flares, Generators of any kind, Illegal substances, Inflatable furniture, Items which may be regarded as weapons, Legal highs (including ‘legal highs’ – this includes Nitrous Oxide and associated equipment including balloons), Laser equipment/pens, Liquids/gels over 100ml, Megaphones, New psychoactive substances (NPS), Petrol burners, Pyrotechnics, unauthorised  professional recording or transmitting equipment, Roller skates, Scooters, Sky or ‘chinese’ lanterns, Smoke bombs / canisters, Sound systems (including personal speakers), Spray cans, Tabards/high viz jackets, unauthorised vehicles including buses, coaches or trucks, unidentified substances, goods with unauthorised Event or artist logos, motorcycle helmets, personal drones.  If you need to bring specific food or drink or medication due to a pre-existing medical condition, please bring supporting medical evidence.

 2.⁠ ⁠Photographic and other recording equipment is permitted if it is for personal non-commercial use only. We reserve the right to charge a licence fee for any commercial use of photographs / visual / audio recordings taken at the Event.

 3.⁠ ⁠The use of drones (including toy drones) or similar is prohibited on or near the Event sites without Our written permission.

 4.⁠ ⁠Other than as referenced in condition 1 of banned items, it is not permitted to bring any external food or beverages into any area/venue within the Event sites.

 5.⁠ ⁠Items that are surrendered or confiscated will not be returned. Anyone resisting the surrender of banned items will face eviction from the Event.

FORCE MAJEURE

 1.⁠ ⁠Force Majeure Event means any circumstance not within a party's reasonable control including, without limitation:

    1. acts of God, flood, drought, earthquake or other natural disaster;

    2. epidemic or pandemic;

    3. terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relation;

    4. nuclear, chemical or biological contamination or sonic boom;

    5. any law or any action taken by a government or public authority, including without limitation imposing an export or import restriction, quota or prohibition, or failing to grant a necessary licence or consent;

    6. collapse of buildings, fire, explosion or accident; and

    7. interruption or failure of utility service.

 1.⁠ ⁠If the Store Owner is prevented, hindered or delayed in or from performing any of its obligations under this agreement by a Force Majeure Event, it shall not be in breach of this agreement or otherwise liable for any such failure or delay in the performance of such obligations. The time for performance of such obligations shall be extended accordingly.

PHOTOGRAPHY & VIDEO RECORDING

 1.⁠ ⁠You must not take any unauthorised audio, video, photographic or digital recording apparatus of any kind into any of the performance areas, nor make any audio, video or photographic recordings of any kind. The Event Organiser reserves the right to confiscate any unauthorised audio, video and photographic recordings.

 2.⁠ ⁠You consent to filming and sound recording as members of the audience (at a venue or on-line). 

 3.⁠ ⁠You consent for your photos or videos to be used on our website and across on all of our social media platforms.

DATA PROTECTION

1.⁠ ⁠If you book Tickets with us, we will hold your name, address and other personal data in our database, subject at all times to our Privacy Policy If you wish to make any requests regarding your personal data, please email support.

HEALTH AND SAFETY

 1.⁠ ⁠Fires and the burning of any materials is not permitted anywhere on/in the Event sites.

 2.⁠ ⁠Smoking (including e-cigarettes and/or vaping) is not permitted in enclosed public spaces or buildings.  In the applicable areas of

 3.⁠ ⁠the Event sites, no excessive amounts of cigarettes/vapes shall be permitted – only a reasonable amount for personal consumption.

 4.⁠ ⁠Excessive exposure to loud music may cause damage to your hearing.

 5.⁠ ⁠Pyrotechnics, lasers, smoke machines, strobe lighting/special effects may take place during some performances.

 6.⁠ ⁠All those attending the Event do so at their own risk.

 7.⁠ ⁠No animals, other than guide or hearing dogs, are permitted on the Event sites.
